Canadian Right to Food Trial: 05-09March2012 in Calgary, Alberta

The decision of the trial judge will impact 35 million Canadians.


The CR2FT originated with a bylaw infraction for the possession of urban chickens in Calgary, Alberta. It has since evolved and morphed into a complex legal argument involving such issues as :

A) The jurisdiction of a municipality to determine what we consume.

B) The default consumption model for citizens when personal production, cultivation, growing, raising & household food security is denied.

C) Sustainability of urban ag methods.

D) The Right to Food as guaranteed and protected by the United Nations Declaration of Human Rights, 1948, Article 25 and subsequent legislation, including the International Covenant on Economic, Social and Cultural Rights, 1966

E) The unconstitutionality of the City of Calgary bylaw based on The Canadian Charter of Rights and Freedoms, 1982, S1, S2, S7 & S15 arguments. Substantial breach and violation of rights.

F) The hypocrisy of the City of Calgary's public policies, three of which have been ratified and approved by council.

G) Poor governance practices on the part of the City of Calgary which contravene the Alberta Municipal Government Act, MGA:M-26-3:

Municipal :
3) The purposes of a municipality are:
(a) to provide good government

H) International obligations and responsibilities, pursuant to the UNHRD & ICESSCC.

I) Appropriate remedy. This is presumably based on reasonableness.

As you can read, chicken has not been mentioned once in these 9 points. It is no longer an argument about chickens, per se. The CR2FT is a Right to Food issue now, with consequences that impact all Canadians.

22 countries now have a Right to Food enshrined in their constitution as a result of each nation embracing their international obligations, as set forth in the UNHRD.

It is Canada's turn to meet its international responsibilities and obligations, and to protect the charter rights of its citizens.

Calgary City Council: Fact loses to Fear... Again!??!


We all see and hear that the interrelated issues of chickens/food/household food security/community food security/food justice/local food systems/sustainable agriculture are being discussed not only in Calgary, but across North America & Globally. Myopically, Calgary city council has turned their antiintellectual/antiscience back on our very own proud agrarian heritage and has wittingly endorsed industrial, factory, caged, agribusiness practices.
Regardless of political positioning, food transcends all issues. The inability of city council to:

1. Educate themselves on this issue
2. Defer to unanimously endorsed Federal, Provincial & City Policy recognizing Article 25
3. Support Science Based approaches (Pilot Project)
4. Acknowledge the receipt of 100's of letters of support
5. Disconnect themselves from fear & hearsay
6. Understand Household Food Security

only serves to illustrate the chasm that exists in comprehending this complex issue.

We know:

1. The matter of a Right to Food, represented in this instance by our hens, is going to court.
2. The Food Policy Report is being presented to Calgary Council on 30June10.
3. That regardless of your affiliation, CLUCK, CFPC, SlowFood, CGRN, EAC, AFMA, GFSA, FSC, et al, Food Policy is the common ground where we all come together.

The process to have 99.9% of our population dependent on Industrial Food has taken some 50-70+ years to engineer. This system will not be dismantled anytime soon, but we can begin the process of individually & independently disconnecting ourselves from the Industrial Food Production System by supporting personal and local food policy organizational initiatives.

Should city dwellers be allowed to raise chickens? The latest flashpoint in the great urban chicken debate is Calgary, where a city committee has voted down a pilot proposal. On Friday, Jian spoke to two Calgarian mayoral candidates on opposite sides of the issue, including the former head of CLUCK - the Canadians Liberating Urban Chickens Klub. What side of the chicken wire fence do you stand on? Are urban chickens good for cities?

"MAD CITY CHICKENS"

A CLUCK fundraiser and rally of support for the legal challenge to the City of Calgary Bylaw denying citizens a Right to Food by raising Urban Chickens.
The legal challenge involves 4 levels of government, and includes a defence of the United Nations Human Rights Declaration. It is the first and only defence of the 62 year old UN HRD in Alberta's history based on Article 25. The decision will impact all Canadians and will establish a nationwide precedent for Urban Agriculture.
Two Calgarians have been charged with Possession of Chickens. This is an illegal bylaw and urban farmers are not outlaws or criminals. Raising and growing food is a Human Right and a lawful act.
